Supreme Court of the United States
Moore v. Georgia, 439 U.S. 903 (1978)

Moore v. Georgia

Opinion of the Court

Sup. Ct. Ga.; and

Ct. Crim. App. Tex. Certiorari denied. Reported below: No. 78-5159, 240 Ga. 807, 243 S. E. 2d 1; No. 78-5240, 562 S. W. 2d 857.

Dissenting Opinion

Mr. Justice Brennan and Mr. Justice Marshall,

dissenting.

Adhering to our views that the death penalty is in all circumstances cruel and unusual punishment prohibited by the Eighth and Fourteenth Amendments, Gregg v. Georgia, 428 U. S. 153, 227, 231 (1976), we would grant certiorari and vacate the death sentences in these cases.
