Supreme Court of the United States · Decided July 12, 1984 · Brennan, Marshall
468 U.S. 1221; 82 L. Ed. 2d 890; 105 S. Ct. 16; 53 U.S.L.W. 3013; 1984 U.S. LEXIS 2841 (United States Reports)

Washington v. Wainwright

Opinion of the Court

Application for stay of execution of sentence of death, presented to Justice Powell, and by him referred to the Court, denied.

Dissenting Opinion

Justice Brennan and Justice Marshall,

dissenting.

Adhering to our views that the death penalty is in all circumstances cruel and unusual punishment prohibited by the Eighth and Fourteenth Amendments, Gregg v. Georgia, 428 U. S. 158, 227 (1976) (Brennan, J., dissenting); id., at 231 (Marshall, J., dissenting), we would grant petitioner’s application for a stay of his execution.
