Justice White, Justice Blackmun, and Justice O’Connor dissent and would grant the petition for writ of certiorari, vacate the judgment, and remand the case to the United States Court of Appeals for the Fourth Circuit for further consideration in light of Anderson v. Bessemer City, 470 U. S. 564 (1985).
