DECISION ON STIPULATION 1 On September 25, 2019, Christa Hamilton (“petitioner”) filed a petition for compensation in the National Vaccine Injury Compensation Program. 2 Petition (ECF No. 1). Petitioner alleges that the flu vaccine she received on October 8, 2016 caused her to develop polymyalgia rheumatica. Id. at Preamble.
On January 3, 2024, respondent filed a stipulation providing that a decision should be entered awarding compensation to petitioner. Stipulation at ¶ 7 (ECF No. 73). Respondent denies that the flu immunization caused petitioner’s alleged polymyalgia rheumatica or any other injury. Id. at ¶ 6. Nevertheless, maintaining their respective positions, the parties now agree that the issues between them shall be settled and that a decision should be entered awarding petitioner compensation according to the terms of the stipulation attached hereto as Appendix A. Id. at ¶ 7.
The stipulation provides:
1) A lump sum of $30,000 in the form of a check payable to petitioner. This amount represents all compensation for damages that would be available under 42 U.S.C. § 300aa-15(a) for injuries allegedly related to petitioner’s receipt of the flu vaccine.
Id. at ¶ 8.
Accordingly, the Clerk of the Court SHALL ENTER JUDGMENT in accordance with the terms of the stipulation and this decision. 3
IT IS SO ORDERED. s/ Thomas L. Gowen Thomas L. Gowen Special Master
