DECISION BASED ON STIPULATION 1
On December 9, 2020, Cindal Menard (“Petitioner”) filed a petition in the National Vaccine Injury Program 2 alleging that tetanus-diphtheria-acellular pertussis (“Tdap”), varicella, and hepatitis B vaccinations administered on February 19, 2019 caused her to acute disseminated encephalomyelitis (“ADEM”). Petition at Preamble (ECF No. 1).
On August 26, 2026, the parties filed a stipulation recommending an award of compensation to Petitioner. Stipulation (ECF No. 161). Respondent denies that the vaccines caused Petitioner to suffer from ADEM or any other injury or her current condition. Nevertheless, the parties agree to the joint stipulation, attached hereto as Appendix A. 3 The undersigned finds the stipulation reasonable and adopts it as the decision of the Court in awarding damages, on the terms set forth therein.
The parties stipulate that Petitioner shall receive the following compensation: (1) A lump sum of $196,204.61, which amount represents compensation for first year life care expenses ($6,204.61) and pain and suffering ($190,000.00), to be paid through an ACH deposit to Petitioner’s counsel’s IOLTA account for prompt disbursement to Petitioner.
(2) An amount sufficient to purchase the annuity contract described in paragraph
10 of the Stipulation.
This amount represents compensation for all damages that would be available under 42 U.S.C. § 300aa-15(a). Stipulation at ¶ 8.
The undersigned approves the requested amount for Petitioner’s compensation. Accordingly, an award should be made consistent with the stipulation.
In the absence of a motion for review filed pursuant to RCFC Appendix B, the Clerk of Court SHALL ENTER JUDGMENT in accordance with the terms of the parties’ stipulation. 4
