15 This matter comes before the Court on the Report and Recommendation of Magistrate Judge David W. Christel (Dkt. # 17). The Court, having reviewed the Report and Recommendation, objections to the Report and Recommendation, if any, and the remaining record, does hereby find and ORDER: 19 (1) The Court adopts the Report and Recommendation.1 20 (2) The Amended Complaint fails to state a claim upon which relief can be granted.

21 Therefore, Plaintiff’s claims are dismissed without prejudice and this case is closed.

22 (3) The Clerk is directed to send copies of this Order to Plaintiff and to the Hon. David 23 W. Christel.
