Case ruled by Gaber v. Balsiger, ante, p. 314. The facts and questions involved in this case are the same as those considered and determined in the case of Gaber (Frank) v. Balsiger, ante, p. 314, 10 N.W.2d 290, decided herewith. For the reasons stated in that case, this appeal must be dismissed.
